Terms of Service

These terms govern your use of withu (the "App"). By installing and using the App you agree to these terms.
1. The Service
The App is a personal character companion app for iOS and watchOS that provides:
- Display of characters you create or attach
- Automatic character state changes based on HealthKit data, time, weather, and iOS Focus
- AI character image generation (OpenAI gpt-image)
- Camera compositing, widgets, and watch complications
2. Fees and Purchases
- Downloading and using the App is free.
- AI character generation calls an external service (OpenAI); a limited number of free creations is provided.
- To create beyond the free allowance, you can purchase candies via Apple In-App Purchase. Payment and refunds follow Apple App Store policy.
- Some features require Sign in with Apple.
- To protect operating costs, we may set usage limits; generation may be temporarily restricted when a limit is exceeded.
3. Prohibited Conduct
You must not:
- Enter prompts that infringe others' rights or are defamatory
- Request violent, sexually explicit, or discriminatory content
- Interfere with the normal operation of the App (e.g., exhausting usage limits with repeated automated calls)
- Attempt to violate OpenAI policies through the App
We may block access without prior notice upon discovering such conduct.
4. AI Output Disclaimer
- AI-generated images are produced automatically; we are not responsible for their accuracy, suitability, or copyright status.
- Some prompts may be rejected under OpenAI's safety (moderation) policies.
- Before using generated images commercially, review OpenAI's terms at openai.com/policies.
5. Changes to or Suspension of the Service
- We may change or discontinue part or all of the service with prior notice, or without notice where unavoidable.
- If the App's backend (AI generation server) is discontinued, generation features may stop working; other features (such as displaying characters you already created) continue to work.
6. Limitation of Liability
- The App is provided "as is"; we are not liable for direct, indirect, or incidental damages arising from its use.
- We are not responsible for the accuracy or availability of external APIs such as HealthKit.
7. Changes to These Terms
These terms may be revised to reflect changes in law, policy, or service improvements. Material changes will be announced in-app or via the GitHub repository.
8. Governing Law
These terms are governed by the laws of the Republic of Korea, and disputes are subject to the court having jurisdiction over the operator's address as the court of first instance.
